Theofanous Creations (“we”, “us”, “our”) respects your privacy and is committed to protecting your personal data. This policy explains what we collect, why, how we use it, and your rights under the General Data Protection Regulation (EU 2016/679, “GDPR”) and the Cyprus Law 125(I)/2018 on the protection of personal data.

What personal data we collect

Depending on how you interact with us, we may collect:

  • Identity & contact details: name, email, phone number, billing and delivery address.
  • Account data: username and password (stored encrypted), order history, wishlist, saved preferences.
  • Order & transaction data: items purchased, amounts, delivery details, and a record of payment. We do not store your full card number (see “Data security” below).
  • Personalisation content: any text, names, dates, photos, images or design files you upload or send us for personalised products (for example mugs, frames, wood and acrylic creations, typography, invitations).
  • Communications: messages you send us by email, phone, contact form or social media.
  • Technical & usage data: IP address, browser and device type, and how you use our website, collected via cookies (see our Cookie Policy).
  • In-store data: details you give us in our shop for orders, quotes or receipts.

You can withdraw your consent at any time (for example by unsubscribing from emails or changing your cookie settings) without affecting processing already carried out.

Who we share your data with

We never sell your data. We share it only with trusted parties who help us run the business, under appropriate confidentiality and data-processing terms:

  • Payment providers, to process payments securely.
  • Couriers and delivery partners, to deliver your order.
  • Website hosting and IT providers.
  • Email and marketing tools, if you subscribe.
  • Our accountant, auditor and professional advisers.
  • Public authorities, where required by law (for example tax authorities or courts).

International transfers

Some of our service providers may process data outside the European Economic Area (EEA). Where they do, we make sure appropriate safeguards are in place, such as the European Commission’s Standard Contractual Clauses or an adequacy decision.

How long we keep your data

  • Order, invoice and tax records: kept for the period required by Cyprus tax law (generally 6 years).
  • Account data: kept while your account is active; deleted on request or after a long period of inactivity.
  • Personalisation files and photos: kept only as long as needed to fulfil and support your order, then deleted, unless you ask us to keep them for re-orders.
  • Marketing data: kept until you unsubscribe.

Data security

We use appropriate technical and organisational measures — including encrypted connections (SSL/HTTPS), access controls and secure, reputable service providers — to protect your data against loss, misuse or unauthorised access. No system is completely secure, but we take security seriously and review our measures regularly.

Your rights

Under the GDPR you have the right to: access the personal data we hold about you; have inaccurate or incomplete data corrected; have your data erased (“right to be forgotten”); restrict or object to processing; receive your data in a portable format; withdraw consent at any time; and not be subject to solely automated decision-making with legal effects (we do not carry out such profiling).

Right to complain

If you believe we have mishandled your data, please contact us first so we can put things right. You also have the right to lodge a complaint with the Office of the Commissioner for Personal Data Protection (Cyprus) — www.dataprotection.gov.cy.

Children

Our products and website are intended for adults. We do not knowingly collect data from children under 16 without parental consent. If you believe a child has provided us with data, contact us and we will delete it.

Changes

We may update this policy from time to time. The “last updated” date above shows the latest version, and material changes will be highlighted on our website.

Terms & Conditions

These Terms govern your use of theofanouscreations.com (the “Site”) and any purchase you make from us, whether online or in our shop. By using the Site or placing an order, you agree to these Terms. Please read them carefully and keep a copy.

Definitions

“We”, “us” and “our” mean Theofanous Creations. “You” means the customer. “Products” means goods offered for sale. “Personalised Products” means goods made or customised to your specifications (see “Personalised and custom orders” below and our Personalised & Custom Orders Policy).

Eligibility and accounts

You must be at least 18 years old to place an order. You are responsible for keeping your account details and password confidential and for all activity under your account. Please notify us immediately of any unauthorised use.

Products and descriptions

We try to describe and picture our Products as accurately as possible. However, because many items are handmade or hand-finished, slight variations in colour, size, finish and texture are normal and are not defects. Colours may also appear differently on different screens, so on-screen images are indicative only. Products are subject to availability, and we may withdraw or change Products at any time.

Prices and VAT

Prices are shown in Euros (€) and include VAT at the applicable Cyprus rate (currently 19% standard; certain goods may be subject to a reduced rate), unless stated otherwise. Delivery charges are shown separately at checkout (see our Shipping & Delivery Policy). We take care to price correctly, but if an obvious pricing error is found, we will contact you before processing, and you may confirm at the correct price or cancel.

How a contract is formed

  1. You place an order through the Site (or in our shop).
  2. You receive an order acknowledgement confirming we have received it — this is not acceptance.
  3. A binding contract is formed only when we send you a confirmation or dispatch notice (or, for in-store and custom orders, when we confirm we are proceeding).
  4. We may decline an order — for example due to stock issues, suspected fraud, a pricing error, or inability to deliver to your area — and will refund any payment taken.

Payment

Accepted methods and payment security are set out in our Payment & Pricing Policy. Ownership of the Products passes to you only once we have received full payment.

Personalised and custom orders

Personalised Products are made to your specifications. By ordering, you confirm that the details you provide (spelling, names, dates, images) are correct and that you hold the rights to any content you supply. Personalised Products cannot be cancelled, returned or refunded once production has begun, except where they are faulty or not as agreed — see our Personalised & Custom Orders Policy and Returns, Refunds & Cancellation Policy.

Delivery and risk

Delivery terms are set out in our Shipping & Delivery Policy. Risk in the Products passes to you on delivery, or on collection from our shop.

Right of withdrawal and returns

If you are a consumer buying online, you have a statutory right to withdraw within 14 days, subject to legal exceptions (notably personalised, perishable and certain hygiene items). Your rights and the procedure are explained in full in our Returns, Refunds & Cancellation Policy.

Legal guarantee (conformity of goods)

As a consumer, you are entitled by law to Products that match their description and are fit for purpose. If a Product is faulty or not as described, you are entitled to remedies — repair, replacement, price reduction or refund — under the Cyprus Consumer Rights Law and the EU Sale of Goods rules (Directive (EU) 2019/771), generally for up to 2 years from delivery. This is in addition to, and not affected by, your right of withdrawal.

Intellectual property

All content on the Site (logos, text, images, designs and the “Theofanous Creations” brand) is owned by or licensed to us and may not be copied or used without permission. When you upload content for personalisation, you grant us a limited licence to use it solely to produce your order. You warrant that you own or have permission to use that content and that it does not infringe anyone’s rights or any law.

Acceptable use

You agree not to misuse the Site — for example by attempting to gain unauthorised access, introducing malicious code, or submitting unlawful, offensive or infringing content for personalisation. We may refuse or cancel any order that breaches these Terms or the law.

Our liability

Nothing in these Terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, for fraud, or for your statutory consumer rights. Subject to that, we are not liable for losses that were not foreseeable, or for delays caused by events beyond our reasonable control. Our total liability for any order will not exceed the amount you paid for it.

Events beyond our control (force majeure)

We are not responsible for any failure or delay caused by events beyond our reasonable control, including strikes, supplier or courier failures, extreme weather, power or internet outages, or other emergencies. We will let you know and, where appropriate, offer a revised date or a refund.

Governing law and jurisdiction

These Terms are governed by the laws of the Republic of Cyprus, and disputes are subject to the jurisdiction of the Cyprus courts. As a consumer, you also benefit from the mandatory protections of the law of your country of residence within the EU.

Complaints and dispute resolution

We want every customer to be happy. If something goes wrong, please contact us first at christina.grafistiki@gmail.com and we will try to resolve it quickly. If we cannot resolve it, you may contact the Consumer Protection Service of the Cyprus Ministry of Energy, Commerce and Industry, which offers consumer advice and mediation (hotline 1429 / www.consumer.gov.cy). Please note that the EU Online Dispute Resolution (ODR) platform was discontinued on 20 July 2025 and is no longer available; alternative dispute resolution through certified national bodies remains available.

Changes to these Terms

We may update these Terms. The version in force is the one published on the Site at the time of your order.




Returns, Refunds & Cancellation Policy

We want you to love your purchase. This policy explains your rights and how to return items. It distinguishes between online (distance) purchases, in-store purchases and faulty goods, because the law treats them differently.

Online purchases — your 14-day right of withdrawal

If you are a consumer and bought online, you may cancel within 14 days of receiving the goods, without giving any reason, under the Cyprus Consumer Rights Law of 2013 (transposing EU Directive 2011/83/EU).

How it works:

  • The 14-day period starts the day after you (or someone you nominate) receive the goods. For multiple items in one order delivered separately, it starts the day after the last item arrives.
  • To withdraw, tell us clearly within the 14 days — by email at christina.grafistiki@gmail.com, by phone, or using the model withdrawal form at the end of this policy.
  • After notifying us, return the goods without undue delay and within 14 days.
  • Refund: we refund the price plus standard delivery within 14 days of receiving the returned goods back (or proof that you have sent them). If you chose a more expensive delivery option than our standard one, we refund only the standard amount.
  • Return shipping cost: unless the item is faulty or we sent the wrong item, you pay the cost of returning the goods.
  • Condition: you may inspect items as you would in a shop. If their value is reduced by handling beyond what is necessary to check their nature and function, we may deduct a corresponding amount from your refund.
  • Refund method: to your original payment method, unless agreed otherwise.

Items that cannot be returned under the 14-day right

By law, the right of withdrawal does not apply to certain items, which is important given our product range:

  • Personalised or custom-made products — anything made to your specification or clearly personalised (for example personalised mugs, frames, wood and acrylic creations, typography, invitations and custom prints).
  • Perishable goods or goods that deteriorate quickly — for example food items and fresh or preserved floral items such as Forever Roses.
  • Sealed goods unsuitable for return for health or hygiene reasons, once unsealed after delivery — for example underwear, socks and earrings or other pierced items.
  • Made-up event items prepared for a specific date or event (for example inflated balloons and assembled decorations), and services already fully performed with your agreement (for example completed event decoration).

These exceptions exist because such items cannot be resold. Of course, if any of these arrive faulty or not as agreed, your guarantee rights below still fully apply.

In-store purchases

Purchases made in our shop are not covered by the 14-day distance-selling right, which applies to online and distance purchases only. For in-store purchases: if goods are faulty, you have the full legal guarantee rights described below; and, as a goodwill gesture for a change of mind, we offer an exchange or store credit within 14 days on unused items in their original condition and with proof of purchase. This goodwill policy is voluntary, not a legal obligation, and does not apply to personalised, perishable or hygiene items.

Faulty, damaged or incorrect items (legal guarantee)

Separately from the right of withdrawal, if an item is faulty, not as described or not fit for purpose, you are entitled by law (Cyprus Consumer Rights Law; EU Directive (EU) 2019/771) to a remedy — normally repair or replacement, and if that is not possible or appropriate, a price reduction or refund — generally for up to 2 years from delivery.

  • Damaged in transit: please tell us within 48 hours of delivery, with photos, and we will arrange a replacement or refund at no cost to you.
  • Wrong item received: we will arrange the correct item or a full refund, including any return costs, at no cost to you.

How to return an item

  2. We will confirm the return address and any instructions.
  3. Pack items securely, ideally in their original packaging, and include proof of purchase.
  4. We recommend a tracked return service. Until we receive the goods, they remain your responsibility (unless the item is faulty or the error is ours).

Refund timing

Approved refunds are issued within 14 days to your original payment method. The time for the funds to appear depends on your bank or card provider.

Shipping & Delivery Policy

Where we deliver

We deliver throughout Cyprus (areas controlled by the Republic of Cyprus).

Click & Collect (in-store pickup)

You are welcome to collect your order free of charge from our shop at Makarios III Avenue 9, Ormideia, Larnaca. We will let you know when it is ready. Please bring your order confirmation and ID.

Processing times

  • In-stock items: dispatched within 1–2 business days.
  • Personalised, custom or handmade items: require additional production time, typically 3–7 business days, confirmed at the time of order. We may contact you to approve a proof or mockup before production (see our Personalised & Custom Orders Policy).
  • Event items (balloons, decorations): arranged for your event date — please order well in advance.

Delivery times and costs

Estimated delivery is 1–3 business days after dispatch within Cyprus. Delivery costs are calculated automatically at checkout based on your order and delivery address, and any free-delivery offers will be shown there.

Tracking

Where available, we will send you a tracking number once your order has been dispatched.

Delays and peak periods

We aim to meet all estimates, but delivery times are not guaranteed and may be longer during peak seasons (such as Christmas, Easter, Valentine’s Day and graduation season) or due to events beyond our control. We will keep you informed of any significant delay.

Incorrect or incomplete address

Please check your delivery details carefully. We are not responsible for delays or failed deliveries caused by an incorrect or incomplete address, and re-delivery may incur an additional charge.

Risk and ownership

Risk passes to you on delivery or collection. Ownership passes once full payment has been received.

Missing or delayed parcels

Payment & Pricing Policy

Accepted payment methods

We accept major debit and credit cards (Visa and Mastercard) online and in our shop. In our shop we also accept cash. Online card payments are processed securely by our payment provider over an encrypted connection.

Currency and VAT

All prices are in Euros (€) and include VAT at the applicable Cyprus rate (currently 19% standard; certain goods may be subject to a reduced rate), unless stated otherwise. A receipt or invoice is provided for every purchase.

When payment is taken

Payment is taken at the time of order. For certain large or custom orders we may request a deposit to begin production, with the balance due before dispatch or collection.

Payment security

Card payments are processed by our PCI-DSS-compliant payment provider over an encrypted (SSL) connection. We do not see or store your full card details.

Pricing accuracy

We take care to display correct prices. If a clear error occurs, we will contact you before processing your order, and you may confirm at the correct price or cancel for a full refund.

Wholesale and business orders

Wholesale and business-to-business orders (for example wholesale Easter candles) may be subject to separate terms, pricing and minimum quantities, agreed in writing. The 14-day consumer right of withdrawal does not apply to business purchases.




Personalised & Custom Orders Policy

Personalisation is at the heart of what we do. This policy makes the process clear and protects both sides.

Accuracy is your responsibility

Please double-check all details you provide — the spelling of names, dates, wording and any custom text. We produce personalised items exactly as submitted and approved, so we cannot refund or replace an item because of an error in the information you supplied.

Proof and mockup approval

For many custom items we will send you a digital proof or mockup for approval before production. Production begins only after you approve it, and once approved the design is final.

Images and files you supply

Please supply high-resolution images. Low-quality images may print blurry or pixelated; we will flag this where we can, but we are not responsible for the quality of customer-supplied images. Colours may vary slightly between screen and the finished product, and between materials, due to the nature of printing and handmade finishing.

Rights and content

By submitting text, images, logos or designs, you confirm that you own them or have permission to use them, and that they do not infringe any copyright, trademark or other right and are not unlawful, offensive or defamatory. You agree to indemnify us against any claim arising from content you supply. We may refuse any personalisation request that we believe infringes rights or the law, or is otherwise inappropriate.

No cancellation or return once in production

Because personalised items are made for you and cannot be resold, they are exempt from the 14-day right of withdrawal and cannot be cancelled, returned or refunded once production has started — unless the item is faulty, damaged or differs from the approved proof, in which case we will repair, replace or refund it (see our Returns, Refunds & Cancellation Policy).

Production time

Custom items take longer than stock items. We will give you an estimated completion date at the time of order. Please order early for events and peak seasons.

Deposits

For large, bulk or high-value custom orders we may require a non-refundable deposit to begin work, with the balance due before delivery or collection.
